We, the members of Local 2164, United Automobile, Aerospace and Agricultural Implement Workers of America, realize that the struggle to better our moral, social and economic conditions is in vain, unless we are united to protect ourselves collectively against our employer.
INTRODUCTION AND OBJECTIVE
We the member of Local 2164, United Automobile, Aerospace and Agricultural Implement Workers of America, herein referred to as Local 2164, UAW, dedicate this organization to the uniting of all workers in the plant under our jurisdiction, regardless of craft, age, sex, race, nationality, creed, religion, or political affiliation. We shall purse at all times an aggressive policy to improve the working and living conditions to all workers under our jurisdiction. To become a real community institution using our powers for ultimate good of all the people employed in the workshops of Bowling Green, Kentucky and vicinity.
ARTICLE 1
“Name”
Section 1. This organization shall be known as Local 2164, United Automobile, Aerospace and Agricultural Implement Workers of America, UAW, of Bowling Green, Kentucky.
ARTICLE 2
“Affiliation”
Section 1. Local 2164 shall be affiliated with the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America, UAW.
ARTICLE 3
“Jurisdiction”
Section 1. Local 2164 shall be composed of workers eligible for membership in the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America and over whom Local 2164 is granted jurisdiction by the International Union.
ARTICLE 4
“Duties of Members”
Section 1. It shall be the duty of each member to conscientiously seek to understand and exemplify by practice, the intent and purpose of his/her obligations as a member of Local 2164 and the International Union.
Section 2. It shall be the duty of each member to participate in all local, state and federal elections through registration and balloting.
Section 3. Every person prior to his/her acceptance as a member shall be given the membership oath provided for in Article 43 of the International Constitution.
Section 4. Any member who attends a meeting in an intoxicated condition and/or creates a disturbance or becomes unruly shall lose voice and his/her right at said meeting by order of the chairperson, subject to the challenge of the membership. Flagrant or persistent violation of this section by any member shall be conduct unbecoming a union member.
Section 5. The constitution of this organization shall be the constitution of the International Union, UAW, and these bylaws shall be in all respects subordinated to said constitution and all applications and interpretations thereof.
Section 6. Delegates shall present a written report to the regular Membership Meeting following attendance at a convention or council on behalf of the Local.
ARTICLE 5
“Membership Card and Rules”
Section 1. A membership card, a copy of the International Constitution, Local Union Bylaws, and the National and Local Agreements shall be given to members upon request during regular office hours.
ARTICLE 6
“Representative and Representation”
Section 1. The International Union and this local union shall be the exclusive representative of each member of this local union. For the purpose of collective bargaining in respect to rates of pay, wages, hours of employment, and for other conditions of employment, and for negotiation and execution of any contracts with the employers. Covering all of the aforesaid matters including contracts requiring his/her continued employment and contracts requiring the employer to deduct, collect, or assist in collecting from his/her wages, any dues, initiation fees, reinstatement fees, or fines payable to the International or this local union.
Section 2. Each member of this local union does hereby irrevocably designate, authorize and empower the International Union and Local 2164 to exclusively appear and act for his/her, and in their behalf before any board, court, committee or any tribunal in any matters affecting his/her status as an employee or as a member of Local 2164 or this International Union, and to exclusively act as his/her agent to represent and bind him/her in the presentation, prosecution, adjustment and settlement of all grievances, complaints or disputes of any kind or character arising out of the employer-employee relationship as fully and to all intents and purposes as he/she might or could do if personally present.
ARTICLE 7
“Authority”
Section 1. The highest authority of Local 2164 shall be vested in the general membership meeting, to be called at least once (1) a month, for each shift. All meetings shall be held on the second (2nd) Tuesday of each month. In General Election Years, the General Membership Meeting will be held on the 1st Tuesday in May.
Section 2. Between the general membership meetings, the highest authority shall be the Executive Board of Local 2164.
Section 3. Between the aforesaid meetings, the administrative authority of the local union shall be vested in the President of Local 2164, subject to the approval of the Executive Board and general membership meeting.
Section 4. A quorum will consist of the total number of members on roll at all the membership meetings.
ARTICLE 8
“Executive Officers”
Section 1. The local union shall have the following executive officers:

Section2. The Local 2164 Executive Board shall consist of the President, Vice President, Recording Secretary, Financial Secretary-Treasurer, three(3 Trustee, Sergeant-at-Arms, Guide, the Chairperson of the Shop Committee, and the elected Retiree Member.
Section 3. A quorum of the Executive Board shall consist of 50% (fifty percent) plus one (1) of all the Executive Board members.
Section 4. The Executive Board shall meet on the second Monday of each month prior to the general membership meeting; special meetings shall be called at the discretion of the President of Local 2164 or a majority of the Executive Board members. Executive Board meetings may be canceled in advance by a majority vote of the Executive Board.
Section 5. The starting time of the Executive Board meeting shall be set by the President so that the least possible cost will be incurred by Local 2164. Executive Board members working in the plant shall be excused one-half hour prior to meeting time.
Section 6. In case of an emergency, the Executive Board shall have the authority to make disbursements of local union funds not to exceed $250 (two-hundred fifty dollars) and it shall have the power to direct the payment of all ordinary bills and expenses of the local union.
Section 7. All expenditures, decisions and recommendations of the Executive Board shall be referred to the next regular membership meeting for approval.
Section 8. Any member, who desires to make an appeal to the Executive Board, or to have an audience with the Executive Board, must make request in writing for an appointment. All appeals to the Executive Board must be in writing.
Section 9. The Executive Officers shall be elected in accordance with the International Constitution, Article 38, and it shall be the governing factor.
Section 10. The executive Board shall appoint at least one of its members to each of the standing committees in a liaison or advisory capacity, except the plant bargaining committee, election committee or any trial committee.
ARTICLE 9
“Duties of Executive Officers”
Section 1. The duties of the PRESIDENT shall be as provided for in Article 40 of the International Constitution, with the following addition: “the appointment of all local union committees as provided for in Article 44 of the International Constitution.”
Section 2. The duties of the VICE PRESIDENT shall be as provided in Article 40 of the International Constitution.
Section 3. The duties of the RECORDING SECRETARY shall be as provided for in Article 40, Section 3 of the International Constitution, with the following additions:
1. Minutes of all Executive Board meetings in writing.
2. Minutes of all Membership Meetings in writing.
3. Roll call of all officers and their complete attendance records.
Section 4. The duties of the FINANCIAL SECRETARY-TREASURER as provided for in Article 40, Sections 4 through 11 of the International Constitution.
Section 5. The duties of the TRUSTEES as provided for in Article 40, Section 12 of the International Constitution.
a. In the absence of the Recording Secretary the Trustee Chair shall sign vouchers
Section 6. The duties of the SERGEANT-OF-ARMS as provided for in Article 40, Section 13 of the International Constitution.
ARTICLE 10
“Leaving Office”
Section 1. Article 40, Section 15 of the International Constitution shall apply to all union officers, committees, and other members handling funds or other property of Local 2164. This also includes all grievances (open or settled), brief cases write-ups, contacts of standing committees and any other information helpful to new office holders.
ARTICLE 11
“Initiation, Reinstatement and Dues”
Section 1. The initiation fee shall be $20 (twenty dollars) in compliance with Article 16, Section 1, of the International Constitution.
a. $5 (five dollars) of the initiation fee goes for the New Member Orientation Program.
Section 2. The reinstatement fee and delinquent dues shall be as prescribed in Article 16, Section 9 of the International Constitution.
Section 3. Withdrawal transfer cards shall be issued in compliance with Article 17 of the International Constitution.
ARTICLE 12
“Dues and Allocations”
Section 1. Local union dues shall be two (2) hours pay per month as prescribed in Article 16, Section 2 of the International Constitution.
Section 2. Local union dues for members on layoff drawing benefits in lieu of work as outlined in Article 16, Section 18, shall become effective January 1, 1982, and shall be one (1) hour pay at straight time rate, per month.
Section 3. Disbursement of dues shall be:
30% International Union Administrative Fund
30% International Strike Fund
2% International Family Education
38% Stays local and used as follows:
28% Local Union Administrative Fund
8% Local Union Building Fund
2% Education Fund
1% Recreation and Conservation Fund
1% Retired Members Chapter Fund
3% Citizenship and Legislative Fund in accordance with Kentucky State, County and City UAW CAP Council
Section 4. For the purpose of financing the following standing committees, one (1) cent per member, per month, will be set aside from the local union Administrative Fund until the fund reaches and maintains a balance of $500 (five hundred dollars).
Section 5. The Retired Workers’ Chapter Fund shall reach and maintain a balance of $250 (two-hundred fifty dollars) until the local union has a least 25 (twenty-five) retired members. At this point the ceiling shall be canceled. The excess of the $250 shall be transferred to the local Administrative Fund.
ARTICLE 13
“Fiscal Year”
Section 1. The fiscal year for Local 2164 shall be from January 1 to and including December 31.
ARTICLE 14
“Local Union Expenditures”
Section 1. Withdrawals from local union funds shall be made by check only.
Section 2. Checks shall be drawn by the Financial Secretary on authority of proper vouchers which shall be furnished by the local union, except normal expenditures such as fuel, electric, telephone and other bills that are necessary functions of running the local union.
Section 3. All checks drawn on the local union funds shall be signed by the Financial Secretary and countersigned by the President. The Chairman of the Trustees shall sign checks in the absence of the Financial Secretary-Treasurer and the Vice President shall sign in the absence of the President.
Section 4. All expenditures shall be properly accounted for and entered upon the books of the local union in accordance with the provisions of the International Constitution and these bylaws.
Section 5. All questions involving the spending of $1000.00 or more must be hand count vote at all general membership meetings.
ARTICLE 15
“Officers Expenses”
Section 1. The following officers shall be paid for monthly expenses:
a. President - $100 (one-hundred dollars) monthly
b. Financial Secretary -0 $100 (one-hundred dollars) monthly
c. Chairman of the Shop Committee - $50 (fifty dollars monthly)
d. Recording - $40 (forty dollars) monthly
e. In the absence of the President, the Vice President shall receive expense money in whole or prorated as to the time he/she serves in the President capacity.

Section 2. A member desiring to speak shall rise and address the chairperson. No member shall speak until he has been recognized by the chairperson.
Section 3. No member shall be interrupted when he/she is speaking except to be called to order or for an explanation.
Section 4. No member shall be permitted to speak more than five (5) minutes on any subject unless he/she has permission from the chairperson, or the same is granted by a vote of the membership in attendance.
Section 5. Debate may be stopped on any question by a motion to move the previous question; properly seconded. A majority vote shall be required to stop debate.
Section 6. Decisions of the chair may be appealed by motion and properly seconded. A majority vote shall be required to stop debate.
Section 7. Motion to table shall be in order at all times, and such motion is not debatable.
Section 8. A motion to adjourn shall always be in order after the regular order of business has been carried out and shall be decided without debate.
Section 9. All questions of a parliamentary nature shall be decided by “Roberts Rules of Order.”
ARTICLE 17
“Duties of Local Union Officers”
Section 1. It shall be the duty of the President to preside at all meetings of the local union, sign all orders on the treasury authorized by the local union, countersign all checks issued by the Financial Secretary against accounts of the local union when ordered by the union, enforce the provisions of the Constitution and appoint committees not otherwise provided for. He/she shall be a member 3x-officio of all committees.
ARTICLE 18
“Trials of Officers and Members”
Section 1. Trials of officers and members of this local union shall be conducted in the manner and under the rules provided for in Article 31 of the International Constitution.
ARTICLE 19
“Recall Procedure”
Section 1. A committeeperson or their alternates may be recalled by the members he/she represent for failure to perform the duties of his/her office. This recall procedure applies to the chairperson of the shop committee, zone (when applicable) and district committeepersons.
Section 2. A vote on the question of recalling a committeeperson may be initiated by a petition setting forth the reasons why the recall is sought, and signed by at least 50% (fifty percent) of the current members working under the jurisdiction of the committeeperson or alternate committeeperson.
Section 3. 50% (fifty percent) of the current members working under the jurisdiction of the committeeperson must be present at the recall meeting to establish a quorum.
Section 4... a two-thirds (2/3) vote of those present and voting is necessary to recall.
Section 5. Once a petition to recall a committeeperson is initiated, it must be completed and deposited with the local union President and/or Recording Secretary within 45 (forty-five) days of such date.
Section 6. If the petition is invalid or the meeting called for the purpose of recall decides not to recall the committeeperson, then no further petition citing the same specific complaint; may be deemed valid until one (1) year has elapsed from the date of such action or decision, unless the one (1) year time limit is waived by the International Union President, due to unusual and compelling circumstances.
Section 7. If multiple or frivolous petitions are filed involving the same committeeperson, the Local Union Executive Board may declare the petition invalid and my appeal the matter directly to the office of the President for ruling as to validity.
ARTICLE 20
“Appeals”
Section 1. Any member dissatisfied with the action or decision of the Local Union or any representative thereof, other than the action or decision of the membership of the local union, may submit in writing his/her appeal or complaint to the local union Recording Secretary or present it in person at the next regular membership meeting within 60 (sixty) days as permitted by Article 33 of the International Constitution.
A. The Executive Board shall refer the matter to the bargaining committee if it involves collective bargaining, otherwise, the Executive Board shall consider the matter itself and try to reach a decision.
B. Whichever of those bodies the matter is referred to shall consult with the grievant, permit him/here the opportunity to be heard, and shall reach a recommendation and present the appeal to the membership at the next earliest membership meeting for it to render a decision.
C. The grievant shall be permitted to be excused from the plant if the meeting is held during his regular shift, but shall not be eligible to receive pay for lost time.
D. If the aggrieved member is not satisfied with this decision, he/she then may appeal to the International Union under Article 33, Section 2 (a) of the International Constitution.
ARTICLE 21
“Election Committee Election”
Section 1. The Election Committee shall be elected first by secret ballot at a meeting. All members in good standing are automatically nominated but must be present to accept. They shall be a standing committee and serve for a period of three (3) years. The date for this meeting shall be set by the Executive Board so all members may attend, but in no event less than sixty (60) days prior to the executive officers’ election.
Section 2. The Local Union Officers and Election Committee shall make the determination, at the time of each election, of lost time for the Election Committee, with membership approval and in accordance with Article 28, Section 1 of these Bylaws.
Section 3. The Election Committee shall consist of five (5) persons receiving the highest number of votes and the next one shall be the alternate. The alternate shall be used at the discretion of the Election Committee upon approval of local union. The person receiving the highest number of votes will be considered the chairperson and the person receiving the second high amount of votes will be considered the co-chairperson of the Election Committee.
ARTICLE 22
“Elections to Conduct”
Section 1. Election of

Section 2. The Chairperson of the Shop Committee and the Zone Committeeperson (when applicable) shall be elected at large by a majority vote to a three (3) year term. [Majority vote interpretation by UAW CONSTITUTION (Las Vegas, June 2002), Article 38, Sec. 2 (4) page 200.]
Section 3. The District (shop) Committee and Alternate Committeepersons shall be elected by majority vote by members voting from the district they will represent, and shall serve a three(3) year term; elections to coincide with Chairman and Zone Committeeman (when applicable) elections.
Section 4. Skilled tradespersons elected by plurality vote to the Skilled Trades Friction Point Committee, by the voting tradespersons they represent, will serve a three (3) year term, election to coincide with the nearest Committee election.
Section 5. As per National Agreement, the Special Skilled Trades Representative shall be elected by plurality vote by the voting tradespersons he/she will represent, and will serve a three (3) year term; elections to coincide with nearest Committee election.
ARTICLE 23
“Duties of Election Committee”
Section 1. The Election committee shall supervise the election, safeguard the ballots until election is complete, distribute ballots, conduct the counting and tabulating of the same, direct that notices be sent out at least seven (7) days prior to acceptance of nominations; stating the date set for the elections and for possible run-off elections and preserve the ballots for a period of one (1) year, unless there is an appeal, then the ballots will be preserved indefinitely until the appeal is finally resolved, posting the results at the Union Hall immediately and making a complete report of the election results at the membership meeting following the election.
Section 2. The newly elected officers shall take office at the beginning of their shift on June 1, following the results of the election. If June 1 falls on a non-work day, the newly elected officers will take office at the beginning of their shift on the next work day. Where a vacancy occurs within sixty (60) days before the date upon which the regular elections are to be held, no election shall take place to fill the vacancy. Such vacancy will be filled by temporary appointment. The President will have the authority to appoint all Executive Offices and the Chairperson of the Sop Committee will have the authority to appoint all shop committee. The President is excluded from this section due to the Vice President taking over his duties.
Article 24
“Polling Place and Time”
Section 1. The polls shall be the local union hall or another location in the vicinity that has adequate room and parking to accommodate larger elections. This decision shall be made by the membership with recommendation of the chairperson of the Election Committee.
a. “The polls for the Executive Officers, Delegates to Conventions, Chairperson of the Shop Committee, Zone Committeeperson, and District and Alternate Committeepersons shall be open from 5:00am until 6:00pm. Ratification will be from 5:00am until 6:00pm.”
b. When a District or Alternate Committeeperson election is held due to a vacancy, polls will be open (2) hours immediately after work, whichever shift is involved. Elections to fill vacancies on the Executive Board will be set by the Local Union Executive Board subject to membership approval.
c. No more than three (3) members of the Election Committee shall conduct this election.
d. Lost time shall not exceed six (6) hours per Election Committee member.
Section 3. All triennial executive elections shall be held the second Tuesday of May.
Section 4. The chairperson and co-chairperson of the Election Committee shall be excused one (1) day prior to the election in order to pick up the ballots and set up for the election. The remainder of the Election Committee shall be excused from work or report to work one (1) hour prior to the polls opening. All elections shall be held on Tuesday, and all results shall be available by the end of the day on Thursday. Lost time will be paid at the regular rate of pay, cost of living and future increases included.
ARTICLE 25
“Ballots and Voting Procedure”
Section 1.
a. The ballots for Executive Officers shall be white.
b. The ballots for Chairperson of the Shop Committee shall be red.
c. The ballots for Zone Committeeperson shall be blue.
d. The ballots for District and Alternate Committeeperson of each district shall be a differ color to determine the district.
e. A sample ballot for each district will be clearly posted on a particular ballot box for that district and shift to be deposited in.
f. There shall be a separate ballot box for Executive Officers with a clearly posted sample ballot.
g. There shall be a separate ballot box for Chairperson of the Shop Committee with a clearly posted sample ballot.
h. There shall be a separate ballot and ballot box, plainly labeled, for Delegates to Conventions or Councils.
i. When a ballot contains more than one (1) “x” or mark for any particular office, that part of the ballot will be considered void, the rest of the ballot will be considered valid.
j. The ballots for Special Skilled Trades Representative will be a different color to determine each shift, a separate ballot box will be provided.
k. Union membership card or GM employee card shall be accepted as proper identification for all elections.
ARTICLE 26
“Nominations and General Rules”
Section 1. All members who have acquired seniority and are in continuous good standing for thirty (30) days immediately prior to nominations stand automatically nominated for the elective offices of Chairperson of the Sop Committee, Zone Committeeperson, Committeeperson and Alternate Committeeperson of the local union.
All members in continuous good standing for one (1) year immediately prior to nominations stand automatically nominated for the Executive offices of the local union.
Zone Committeepersons must be from the zone in which they accept nomination and working in that zone prior to the deadline for acceptance of nomination.
Committeepersons and Alternate Committeepersons must be from the district in which they accept nomination and working in that district prior to the deadline for acceptance of nomination.
Section 2. All acceptance of nomination must be in writing by registered mail or hand delivered and receipted by the President of the local union or Chairperson of the Election committee prior to the deadline for accepting nominations. All acceptance of nomination must state:
a. the office for which he/she wishes to be a candidate
b. seniority date
c. district in the plant which he/she is working as well as the shift
d. social security number
e. name printed as he/she wishes to appear on the election ballot
f. signature
Section 3. Any activities unbecoming the proper decorum of election, such as: drinking of alcoholic beverages or gambling in the immediate vicinity of the polling place is prohibited, including the parking lot of the polling place.
Section 4. Procedure for Limited Absentee Balloting (In accordance with Article 38, Section 10(b) of the UAW International Constitution):
A Local Union may make provisions for members to vote in their Local Union elections, as indicated above, at its option wherever practical. Should the Local Union determine that it desires or requires such provisions, the Local Union may, by affirmative action of the membership, provide for such voting.
The procedure that may be adopted by the Local Union prior to nominations in any election, in which such rules would apply, is as follows:
a. A member who will be away from her/his Local Union during the entire period of an election of executive officers or Convention delegates on a work assignment for her/his employer or on Local Union business may apply for an absentee ballot by filing with her/his Local Union, by mail (registered or certified) or in person, a signed statement that she/he will be away from her/his Local Union for the entire period of the election on a work assignment by her/his employer or on Local Union Business. Such statement or request must be filled with the Local Union in sufficient time for the member to secure a ballot and redeposit same with the Local Union prior to the start of the election.
b. Upon such certified application, the Local Union shall immediately provide the member with a ballot and two envelopes, one return-addressed. The member shall place her/his marked ballot in the unmarked envelope and enclose it in the return-addressed envelope.
c. The ballot as indicated may then be presented to the Local Union in person or as contained in the return-addressed envelope returned by mail (registered or certified). However, under either circumstance, the ballot must be received by the Local Union before the start of the election.
d. Members who will be out of town on union or company business on ratification or Election Day may vote at the hall by absentee ballot on the Friday, immediately prior to the vote, from 5:30pm until 6:30pm. Voters will place their folded ballot in an envelope provided by the election chair or co-chair. The envelope containing the ballots will be sealed and secured by the election chair or co chair until 6pm on the day of the election or ratification, when they will be counted by the election committee.
Section 5. When a candidate is running for an elective office and is unopposed, no election will be held. He/She will be considered elected.
Section 6. No campaigning, passing out handbills, etc., shall be allowed within one hundred feet (100’) of the entrance of the polling place.
Section 7. No member of the Election Committee shall campaign or solicit votes for any candidate.
Section 8. No member shall hold more than one (1) elective office at one time.
a. If a member holding elected office, the term of which is not expiring, desires to become a candidate for another elected office, such member is obligated to notify the local union of his/her resignation from the member’s present office sufficiently in advance of the nomination period to permit the nomination and election of candidates for both offices during the same election. Such resignation would become effective at the time of installation of newly elected officers.
Section 9. Any candidate shall have the right to petition for a re-count. A petition must be filed in writing with the Election Committee within five (5) days after the election. The petition must set forth, herby, the reasons for seeking a re-count. Where the difference between the person receiving the highest number of votes is less than one (1) percent of the total votes cast for that office, the Election Committee shall automatically grant such a re-count upon request. All other requests must be acted on accordingly to their merits.
Section 10. Any candidate may have one (1) challenger or watcher at elections or counting of ballots at his/her own expense. Challenger’s name must be submitted twenty four (24) hours in advance.
Section 11. Any fraud in local union elections shall be dealt with in accordance with Article 49 of the UAW International Constitution.
Section 12. Candidates for local union offices are prohibited from distributing any single item costing more than $5.00 so as not to be construed as buying votes. Proper items for distribution shall include: pens, paper, balloons, pins, combs, calendars, which must bear the name of the candidate on each item. The only exclusion to this is union made hats or t-shirts which must bear the name of the candidate.
ARTICLE 27
“Obligations of all Office Holders”
Section 1. Any member serving on any standing committee who does not function shall be removed and replaced, and shall not be eligible to serve on any appointed committee for the ensuing year.
Section 2. All members of this local union holding an elective or appointed position are required to attend:
a. Two out of three consecutive membership meetings unless officially excused for cause by the Local Union Excuse Committee (LUEC): President, Financial Secretary, and Recording Secretary.
b. Two out of every three consecutive meetings, other than membership meetings, expected of their respective office or position, unless officially excused for cause by the LUEC.
c. Failure of any elected or appointed official to comply with the above attendance rules shall result in automatic removal from their respective office or position, and they shall not be permitted to run for any elective office for the balance of the term of office from which they were removed, except as a delegate to the International Constitutional Convention.
d. Appointed/Elected Officers must attend union membership meetings on their own time, not on company time, unless requested by the president to attend a different meeting.
ARTICLE 28
“Lost Time”
Section 1 The local union shall pay a representative or member lost time only when that representative or member is performing necessary duties of and on behalf of the local union during a time for which he/she would otherwise be compensated by the employer. The amount of lost time should never exceed the amount which the local union representatives or members would otherwise have received from his/her employer for the same period of time for which he/she is being compensated by the local union and lost time must be limited to the minimum time necessary to perform union business. No overtime on lost time will be paid when general fund is below $30,000. The amount of lost time paid while traveling on union business will be limited to straight time hours only.
All lost time shall be reported to the membership by amount and name as part of the financial statement. Prior approval for the lost time must be approved by the local union President; the Chairman of the Shop Committee will recommend lost time for the Bargaining Committee. Lost time will be paid on weekends only when full production is scheduled. If a member loses a portion of his/her vacation, profit sharing or performance bonus while on lost time, the member will be reimbursed by the local union the portion thereof that he/she would have otherwise received from the employer if he/she had not been on lost time, using the same percentages, formulas, and dates of payment as the employer uses to calculate bonuses, profit sharing, and vacation.
a. The office of Financial Secretary will be part-time and will be paid according to the following plant work schedules.
FOUR DAY STRAIGHT TIME PLANT SCHEDULE, MONDAY THROUGH THURSDAY, 10 HOURS DAILY
The office will be paid on Monday 10 hours; Wednesday 5 hours; and Thursday 10
hours, excluding holidays, downtime, or indefinite layoff.
FIVE DAYS STRAIGHT TIME PLANT SCHEDULE, MONDAY THROUGH FRIDAY, 8 HOURS DAILY
The office will be paid on Monday, Wednesday and Friday 8 hours each, excluding
Holidays, downtime or indefinite layoff.
b. The office of Recording Secretary will be part-time and will be paid according to the following plant
work schedules:
FOUR DAY STRAIGHT TIME PLANT SCHEDULE AT 10 HOURS DAILY, MONDAY THROUGH THURSDAY
The office will be paid one half (1/2) day on Wednesday for 5 hours each week, excluding holidays, downtime, or indefinite layoff.
FIVE DAY STRAIGHT TIME PLANT SCHEDULE AT 8 HOURS DAILY, MONDAY THROUGH FRIDAY
The office will be paid one half (1/2) day on Wednesday each week for 4 hours excluding
Holidays, downtime, or indefinite layoff.
e. A qualified bookkeeper will be hired at $15 an hour, without benefits, for up to 24 hours a week. Additional hours may be necessary during tax periods or labor department filings with consent of the local president and trustee chairperson. The bookkeeper’s responsibilities may include the following: Keeps records of financial transactions for UAW local 2164. Verifies, allocates, and post details of business transactions to subsidiary accounts in journals or computer printouts. Summarizes details in separate ledgers or computer files and transfers data to general ledger. Reconciles and balances accounts. Compile reports to show statistics, such as cash receipts and expenditures, dues, accounts payable and receivable, profit and loss, and other items pertinent to operation of business. Calculate employee wages from time cards and prepare vouchers and checks for payment of wages. May prepare withholding, social security, and other tax reports and any required labor department forms. Bookkeeper will not, under any circumstance, be authorized to sign checks for payments of any kind.
Section 2. Union Trips
a. Transportation: Coach airfare, or, when mileage is required (whichever Is; more economical unless approved by local union president), is too paid at the allowable Internal Revenue Service limit, not to exceed the International policy. Mileage is paid only to the driver of the vehicle. Parking and toll road fees will be refunded with paid receipt. (This section changed)
b. Lodging: When overnight is requir4ed,single room occupancy or one half of double room rate, if shared with another member, will be reimbursed upon presentation of receipts.
c. Expenses: If a member is at least 100 miles from the local union hall and an overnight is required, member will receive International Union rate per diem. If overnight is not required, member will receive $20. When any meeting is held within 150 (one hundred fifty) miles of Bowling Green, an overnight stay is considered unnecessary for overnight stay, unless meetings exceed one (1) day. Expense money will not exceed one day for traveling time regardless of mode of transportation.
d. Any and all delegates sent to any conventions, conferences, sub council meetings, etc., who do not attend designated meetings and are receiving lost time pay and/or per diem, will be required to refund all money for each day he/she does not attend such meeting. Excuses for non-attendance shall be brought before the membership for their approval or disapproval of the absence(s). If the membership accepts the absence excuse, the member will be paid.
e. Taxi Cab Fare: the local union will refund the taxicab fare when it is necessary from the airport to the hotel/motel upon arrival or departure from the hotel/motel to the airport for return home. A paid receipt form the taxi company must be presented to receive such refund.
f. Airport Parking: when overnight parking at an airport is necessary, reimbursement will be made along with paid receipt of long-term parking.
g. Any member traveling on union business shall be responsible for making their personal travel arrangements and, if necessary, for securing overnight accommodation. Those wishing to have the union make these arrangements for them must provide a credit card number to the union on which all deposits for their personal arrangement shall be made. Under no circumstances shall the financial secretary or any other officer of this local use their personal credit card to secure the travel expenses of another.
h. Any and all members sent to any conference, sub council meeting, etc. And which are paid or in full by the local union shall give a report to the membership at the next general membership meeting upon return from the conference or meeting.
Section 3. If the membership of Local 2164, UAW, declines below 950 (nine hundred fifty) active in-plant members for two (2) consecutive months, the local union will automatically go into an austerity program as outlined below:
a. If more than one (1) delegate is to attend a meeting, but less than four (4), the delegates will car pool and only one car expense will be paid for the meeting (refer to Article 28, section 2 (a).
ARTICLE 29
“Summer School and Black Lake Education Center”
Section 1. The selection of candidates for Summer School and education seminars at Black Lake Education center, when there is no recommendation from the International Union of whom to send, members in good standing shall submit their names to the local union Executive Board, with the following information.
a. Seniority date
b. Previous union activities or office held
c. Reason for wanting to attend
Section 2. The local union Executive Board shall select members to attend the aforesaid educational classes by merit and concern for the betterment of the union and such selection shall be subject to the approval of the membership.
Section 3. Lost time, travel expenses, lodging and daily expense; money will be paid in accordance with Article 28 of these bylaws, when applicable.
ARTICLE 30
“Welfare”
Section 1. The local union, upon receiving notice of the death of one of its members, will send a union-0made Bible (of the deceased member’s religious denomination) to the member’s spouse or beneficiary. If the family prefers flowers, flowers will be sent to the funeral home.
A. No request for Bibles will be honored for the deceased member beyond sixty (60) days of death.
Section 2. Charitable organizations outside our membership wishing donations for whatever cause must be approved by the general membership, but, in no case shall exceed $100 (one hundred dollars) in any one year.
ARTICLE 31
“Strikes”
Section 1. All strikes shall be called or terminated only in strict conformation with Article 50 of the International Constitution.
Section 2. The local union Strike Committee will set rules and guidelines for local strikes while confirming completely with Article 50 of the International Constitution, and the International Executive Board policy on strike assistance.
Section. All members of this local union shall be personally responsible for maintaining themselves in good standing in the local union and for seeing to it that their correct address is entered on the records of the local union. This union will not be responsible for any mail or notification to members unless this has been co plied with.
Section 4. The Local Union Strike Committee shall consist of all members on appointed standing committees, the Election Committee, the Local 2164 Executive Board (less Chairperson of the Shop Committee). The Strike Committee Chairperson and Co-Chairperson shall be appointed by the President of Local 2164 from the above named members.
ARTICLE 32
“Equipment and Property”
Section 1. All equipment and/or property shall be used only for union business with exceptions on approval of the Local 2164 membership.
Section 2. All equipment and/or property must not be used or allowed to be used for any purpose that may be detrimental to the union cause.
Section 3. Trustees shall make quarterly reports on outside use of union equipment and property.
Section 4. Leases and long term agreements. No agent or official of the Local Union is authorized to execute a real estate lease, deed, service or maintenance contract or other long-term agreement unless the proposed agreement has been reviewed by an outside expert or attorney and approved by the Local Union Executive Board.
ARTICLE 33
“Protection of Rights”
Section 1. No member shall, through the use of force or violence, or threat of use of force or violence, restrain, coerce or intimidate any member for the purpose of interfering with or preventing the exercise of any right to which he/she is entitled to under the provisions of these bylaws.
ARTICLE 34
“Appointments”
Section 1. Any appointed position made by the president, chairman of the bargaining committee, or their designated representatives shall be posted for a period of one (1) week prior to filling the position on all bulletin boards. This one (1) week posting period is to provide all local union members the opportunity to make application, which will be requested on the “position opening: notice. This applies to vacated positions and/or new appointed positions.
ARTICLE 35
“Power of Bylaws”
Section 1. This Constitution and Bylaws of Local 2164 shall in no way conflict or take away the power or rulings of the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America, UAW, adopted June, 1981, and in the event of any conflict, the Constitution of the International Union shall govern.
Section 2. In all places in which reference is made to the masculine it should be deemed to include the feminine.
PARTICLE 36
“Constitution and Bylaws Amendments”
Section 1. These bylaws may be amended in the following manner:
a. These bylaws may be amended by presenting at the union hall a motion in writing setting forth the amendments prior to the executive board meeting, for the membership meeting in which amendment shall be read for the first time. The amendment will then be read to the membership meeting and referred to the Constitution and Bylaws Committee which will report to the succeeding membership meeting, the notice of which must contain a notice of the particular bylaw amendment that will be considered. If approved by two-thirds (2/3) of the membership vote thereon at this succeeding membership meeting, the amendment shall be considered adopted by the membership.
b. Amendments to the bylaws should be made whenever necessary.
c. Copies of the proposed bylaw changes will be distributed at the General Membership Meeting at which final action on these proposals will take place.
d. Two-thirds (2/3) of the membership present and voting is necessary to approve changes and /or additions to the constitution and Bylaws of this Committee.
ARTICLE 37
“Union Picnic and Summer School Expenses”
Section 1. The union picnic will be paid from the General Fund with the amount to be determined and approved by the membership prior to picnic funds being expended.
Section 2. The UAW Summer School expenses will be paid from the General Fund.
ARTICLE 38
Local Union Policies
Section 1. Only made in U.S.A. products can be sold on the property of the UAW 2164, during a UAW function.
